A Mumbai employee has won his case against Tata Consultancy Services (TCS) after the labour commissioner directed the company to release his pending gratuity, nearly a year after he resigned from the firm, reports said.

The employee had approached the Mumbai labour office when TCS allegedly withheld the amount despite his seven years of service. According to details shared by the Forum for IT Employees (FITE), the issue began early last year when the employee took emergency leave to care for his critically ill father, who was admitted to the ICU.
Though he still had sufficient leave balance, TCS reportedly refused to extend his leave and asked him to resume work immediately.

As per reports, while he was at the hospital attending to his father, TCS HR representatives contacted him and gave him an ultimatum to resign and accept 10 months’ salary, or face termination. This pressure was applied even though he was part of an ongoing project, the report added.
Feeling cornered, the employee submitted his resignation and later found a job at another company. However, his situation worsened when he discovered that his gratuity, a statutory payment for employees with over five years of service, had not been released.
He then filed a complaint with the Mumbai labour office, which summoned TCS management and warned them against what it termed “unfair labour practices”. After almost a year, the labour commissioner ordered TCS to pay the full gratuity amount due to him.
The company has since complied with the order and released the pending payment.
